Gabbys parents were talking to her during the Moab stop while she was in the back seat of the police cruiser. Her parents demanded she get away from Brian and fly home but she refused. Separating the man from the crying woman for one night was not the standard procedure for the local law enforcement officers. Police were supposed to follow the procedure they were poorly trained on or not trained at all.

to take the young woman and a man to separate hotels for a night as a solution to domestic violence dispute. Cop says that a good night sleep and a cold shower is going to resolve the problem. What an idiot.
He needs to get fired, but first he needs to be put on the witness stand to testify to the grand jury where he got the idea from. Who trained him or failed to train him.
This is going to be the key element in this case.

Lawyers representing parents of the murdered victim are suing state of Utah.
They are suing for failure to follow local police procedures in a domestic violence call.
A random witness called 911 to report a man physically abusing a young woman on the public street. Police was dispatches in response to the 911 call. Police stopped Brian and Gabby.
Police did not follow their procedures. Police acted in a strange way.
The Plaintiff will use it against the state of Utah in their law suit.
From the legal point it makes no difference what anybody is upset about.
